Welcome to NeighborlyWork. These Terms of Service ("Terms") govern your use of the NeighborlyWork website at neighborlywork.com and all related services (the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.
NeighborlyWork is an online marketplace that connects homeowners seeking HVAC services with vetted, licensed HVAC contractors. We are a marketplace platform only. We are not an HVAC contractor, installer, or service provider. We do not perform any HVAC work, and we do not employ the contractors listed on our platform.
You must be at least 18 years of age and a resident of the United States to use NeighborlyWork. By using the Platform, you represent and warrant that you meet these requirements.
To use NeighborlyWork, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
For Homeowners: Homeowners submit their HVAC project details through our intake form. NeighborlyWork matches the homeowner with up to three vetted local contractors who serve their area. Each contractor submits a blind quote — contractors never see each other's pricing. The homeowner reviews and compares the quotes and selects the contractor of their choice. The homeowner then works directly with the selected contractor for scheduling, installation, and payment for the HVAC work itself.
For Contractors: Contractors apply to join the NeighborlyWork network and are subject to approval. Approved contractors receive matched leads based on their service area and specialties. Contractors submit blind quotes for each lead. If a homeowner selects a contractor and the job is completed and installed, the contractor pays NeighborlyWork the contractor referral fee described below.
Contractor Referral Fee: $800 flat fee per closed install job.
When it is owed: Only when (a) the homeowner selects the contractor through NeighborlyWork and (b) the matched HVAC install or replacement is completed.
What counts as a closed job: A NeighborlyWork-matched homeowner project that becomes a completed HVAC install or replacement performed by the selected contractor.
Billing timing: The fee is billed after the completed install and is due within 30 days.
If a job falls through: No fee is owed for lost bids, unselected quotes, homeowner cancellations before completion, or jobs that do not reach completed installation.
No recurring charges: There are no monthly fees, subscription fees, or charges for leads that do not become closed install jobs.
As a homeowner using NeighborlyWork, you agree to provide accurate and complete information about your home and HVAC needs, respond to contractors and quote communications in a timely manner, make your own independent decision when selecting a contractor, and understand that NeighborlyWork is not a party to any contract between you and a contractor.
As a contractor using NeighborlyWork, you agree to maintain all required state and local licenses and insurance, submit accurate and honest quotes, honor the pricing and terms you quote through the platform, pay the $800 referral fee for each closed install job within 30 days of completion, not contact homeowners matched through NeighborlyWork outside the platform to circumvent the referral fee, and comply with all applicable laws and building codes.
Homeowners: NeighborlyWork is completely free for homeowners. You will never be charged by NeighborlyWork for using our services.
Contractors: The referral fee of $800 per closed install job is due within 30 days of completed installation. No fee is owed for lost bids, unselected quotes, or jobs that do not complete. Failure to pay referral fees may result in suspension or removal from the NeighborlyWork network. NeighborlyWork reserves the right to modify its fee structure with 30 days' written notice to contractors.
NeighborlyWork does not guarantee that homeowners will receive any specific number of quotes, that a contractor will be selected for any job, that any particular contractor's work will meet a homeowner's expectations, or that the platform will generate any specific number of leads for contractors.
NeighborlyWork is a marketplace that facilitates connections between homeowners and contractors. We are not responsible for the quality, safety, legality, or timeliness of any HVAC work performed by contractors, the accuracy of any quotes provided by contractors, any disputes between homeowners and contractors, any property damage, personal injury, or other harm arising from HVAC work, or any contractor's failure to maintain proper licensing or insurance.
To the maximum extent permitted by law, NeighborlyWork's total liability to you for any claims arising from your use of the Platform shall not exceed the amount of fees you have paid to NeighborlyWork in the 12 months preceding the claim.
You agree to indemnify and hold harmless NeighborlyWork, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any applicable law or regulation.
All content on the NeighborlyWork platform, including text, graphics, logos, and software, is the property of NeighborlyWork and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reproduce any content from the Platform without our prior written consent.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. You may also delete your account at any time by contacting us. Upon termination, any outstanding referral fees remain due and payable.
Any disputes arising from these Terms or your use of NeighborlyWork shall be resolved through binding arbitration in Sacramento County, California, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of NeighborlyWork after any changes constitutes your acceptance of the updated Terms.
